A major overhaul of Québec’s privacy regime is on the horizon with the passage of Bill 64 and these changes will have significant consequences for companies doing business in Québec or that handle the personal information of Québec residents.

On September 22, 2021, the Quebec National Assembly adopted and sanctioned Bill 64, the Act to Modernize Legislative Provisions respecting the Protection of Personal Information (“Bill 64”). Bill 64 introduces sweeping reformation to Quebec’s Act Respecting the Protection of Personal Information in the Private Sector (the “Private Sector Act”). This reform will require systematic changes to important business practices, backed up by severe penalties of up to 8% of annual revenues or $50 million for repeat offenders.
